Terms and Conditions Governing Use of E Services Private Limited Trading as E Airport Transfers Booking Services
1.1These terms and conditions and the web-based booking form constitute the entire Agreement concerning the provision of service (“Service”) between you (“the customer”) and E Services Private Limited Trading as E Airport Transfers and shall apply to the provision of any and all carriage, courier or delivery services (“the Services”) undertaken by the Company for the Customer during the continuance of this Agreement and any and all other terms, warranties and/or conditions implied by statute and/or common law and hereby expressly excluded to the fullest extent permitted by law. Completion of the booking form and use of the” Service” indicates your unconditional acceptance of the terms and conditions set out in this Agreement. The Customer agrees that these terms and conditions shall be deemed to apply when the Customer contacts E Services Private Limited Trading as E Airport Transfers to utilize its Taxicab Booking Services.
1.2 E Airport Transfers means E Services Private Limited (company number 7075173) whose registered office is 40 Great Russell Street, LondonWC1B 3PH.
.“You” ,”client” and “your” means any individual, company or other business that places the booking with us.
2.1 You must allow sufficient time when booking your taxicab to allow for the check-in times required by your airline and for any delays caused by traffic conditions. E Airport Transfers shall not be responsible for any delay caused by your failure to allow enough time to reach your destination or if the passengers are not ready for collection at the booked time.
2.2 You must order a suitable car size for the number of passengers and luggage. E Airport Transfers cannot guarantee to carry excessive amounts of luggage. Please note that a child, no matter what age, counts as one passenger. In the event wrong car is ordered by the customer the driver has to refuse the job then the full journey fare is payable to the company.
3. Prices & Payment (charges)
3.1 E Airport Transfers will provide you a quotation based on the information supplied by you. E Airport Transfers may amend the quotation if there is any material change to the original itinerary, the number of passengers, or the type or size of vehicle required. The charges payable by the Customer for the Services (“the Courier Charges”) shall be at the rate specified in the Company’s schedule of charges as in force.
3.2 The quotation will include up to 30 minute waiting period after the advertised landing time and the cost of car parking. E Airport Transfers will charge for waiting at its standard rates after the initial 30 minute period has expired. E Airport Transfers will Endeavour to check for flight delays before the driver leaves for the airport but shall be under no obligation to do so.
3.3 If you accept the quotation, you will receive confirmation of your booking by email. Please check the booking confirmation carefully and inform E Airport Transfers promptly of any errors. E Airport Transfers shall not be responsible for any delays caused or costs arising from by your failure to provide E Airport Transfers with correct information.
3.4 All journeys originating at an airport (which are not return journeys where E Airport Transfers has taken you to the airport) must be prepaid in full at least three days before the date of travel.
3.5 Payment can be made by credit card, debit card (both subject to a 10% surcharge (£5minimum if equal to or less than £50), or cash. All Payment by cheque must be made at least 7Days before the date of travel.
3.6 For all account customers, it is a condition of this agreement that invoices shall be paid in full within 7 days of issue thereof. Should any invoice not be paid within 30 days any outstanding invoices shall immediately become due and payable.
3.7 Without prejudice to E Airport Transfers rights hereunder all monies due to the company in respect of provision of the Services which are not paid by the due date for payment shall bear interest on the balance of such monies due from time to time at the rate of 5% per month until payment is received by the Company in respect thereof.
3.8 The Customer shall not be entitled for any reason to withhold payment of monies due to E Airport Transfers and in particular shall not be entitled to do so in circumstances where the Customer is in dispute with the Company and/or claims money or compensation from the Company in respect of the Services.
3.9 Reservations made for services on the following dates will be subject to an additional 50% Sur charge: 24 December after 1800hrs, all day 25 & 26 December and 31 December after 18.00hrs, all day 01 January. Other bank holidays and train/underground strike days also incur a small charge
3.10 Where the E Airport Transfers has quoted a price for the service other than in accordance with the company’s published price list, the price quoted shall be valid for 24 hours only.
3.11 A maximum waiting time of 15 minutes for address collections and 2hrs for airport collections will be allocated, where upon non contact with passengers will classify the reservation as a no show and will be subject to a full charge.
3.12 All meets are apart from airport pick ups are free for the first 10 minutes, there after a charge of minimum 30 pence per minute will apply for normal cars MPV, Estate and Minibus charges are 60 pence per minute. Airport meets have 30 minutes free waiting.
3.13 In the event the client can not locate the driver at the airport terminal, the passenger must call E Airport Transfers and inform the company of the situation. In the event the client does not inform the companyand leaves the meeting point, the client will be fully charged.
4 The Service
4.1 You shall be responsible for the behavior of all the passengers in the car during the journey. You will be charged £80 to cover cleaning costs in the unlikely event of the vehicle being soiled by any passenger.
4.2 Eating, drinking and/or smoking in the cars are not permitted.
4.3 All children travelling during the journey should be restrained in a manner appropriate to their age, weight and height. Suitable child seats should wherever possible be supplied and fitted by the child’s parents. Such seats may be retained by the driver for use on the return journey.
4.4 E Airport Transfers will not carry more passengers than its insurance or licensing allows.
5.1 If you need to cancel your booking, please contact E Airport Transfers as soon as possible. If you cancel a cash booking after the vehicle has been dispatched then a charge may be incurred; the charge will be based on the distance/time that the allocated driver has travelled/spent prior to the point of cancellation. As a general rule journeys from airports are dispatched up to two hours before flight arrival, journeys within the surrounding area of London are dispatched up to one hour before their due time.
5.2 Cancellation on all guaranteed booking for example booking with credit/debit card must be informed by telephoning E Airport Transfers and give at least 24hours notice; the charge incurred will be £5.
5.3 In the event the client cancels non cash booking by giving less than 24 hours notice, half of the journey fare will be charged any cancellation within six hours of journey start time will be charged fully.
5.4In the event a client books pick up and does not make contact with the driver or E Airport Transfers representative within 2 hours of given pick-up time. This will be considered as a no show and will be fully chargeable.
6.1 E Airport Transfers shall use all reasonable endeavors to get you to your destination on time, but shall not be liable for any loss due to delays caused by road or traffic conditions beyond its control on the journey. Under no circumstances E Airport Transfers shall be liable (in contract, tort or otherwise) for any loss of profits, business or for any indirect or consequential loss whatever.
6.2 All luggages are carried entirely at your risk.
6.3 E Airport Transfers shall be entitled to cancel all services and provide refunds in the event of a declared national emergency, riot, war, fuel shortage, extreme weather or terrorist attack, or other circumstances beyond its control. If the car breaks down during your journey E Airport Transfers will endeavor to arrange an alternative car to complete the journey as soon as practicable otherwise E Airport Transfers will refund the journey fare with no liabilities whatsoever.
6.4 You shall indemnify E Airport Transfers against all losses, costs, damages and expenses arising from any act or omission of any passenger in your party.
6.5 Neither party excludes or limits its liability for death or personal injury caused by negligence, or for willful default or fraudulent misrepresentation or otherwise in any manner unenforceable by any applicable law.
7.1 E Airport Transfers will refuse or terminate any booking with immediate effect if it places any driver or vehicle at risk of damage, violence or abuse by you or by any passenger in your party and will ask all passengers to vacate the vehicle as soon as it is safe to do so. No refunds will be given if the journey is terminated part way through the hire.
8.1 E Airport Transfers may subcontract its obligations under this Agreement. You shall not assign, transfer or delegate any of your rights or obligations under this Agreement.
8.2 E Airport Transfers may change these terms and conditions at any time by posting changes online. Please review these terms and conditions regularly to ensure that you are aware of any changes. All existing bookings will be at the rate quoted or applicable rate in effect at the time of booking.
8.3 E Airport Transfers shall store, process and use all information regarding your personal details in accordance with the requirements of the Data Protection Act 1998.
8.4 This Agreement and any accompanying quotation represent the entire agreement between you and E Airport Transfers in relation to its subject matter. If there is any discrepancy between the terms of this Agreement and the quotation, the terms of this Agreement shall prevail.
8.5 Nothing in this Agreement is intended to confer any benefit on any third party, whether pursuant to the Contracts (Rights of Third Parties) Act 1999 or otherwise, and no third party shall have the right to enforce any rights under this Agreement except where otherwise agreed in writing.
This Agreement shall be construed in accordance with English law and you and E Airport Transfers each agree to submit to the exclusive jurisdiction of the English Courts in respect of any dispute or claim arising out of or in connection with this Agreement.
We will not be responsible for any claim arising as a result of any or all of the following:-
I. the fault of the person(s) affected or any member(s) of their party or
II. the fault of a third party not connected with the provision of the service which we could not have predicted or prevented or
III. the fault of anyone who is not carrying out work for us (generally or in particular) at the time or
IV. An event or circumstance that we or the supplier(s) of the service in question could not have predicted or prevented. This may include (but is not limited to) an occurrence of force majeure as described in these booking conditions.
V. If we are liable to you for any reason, our liability will be limited to the direct costs you incur which are a foreseeable consequence of our failure. This limit does not apply to any liability we may have for death or personal injury resulting from our negligence and for which our liability is unlimited.
10. ALTERATIONS TO THE TERMS AND CONDITIONS
E Airport Transfers reserves the right to alter or vary these terms and conditions at its absolute discretion upon giving reasonable notice to the Customer and without prejudice to the generality or the aforesaid the Company reserves the right to change the Courier Charges. No representations made or variations in or additions to these terms and conditions or warranty given by any person acting or purporting to act on behalf of the Company shall have any force or effect whatsoever unless confirmed in writing by an authorized officer of the Company.
